Certain documents should, therefore, be in place on a business website to ensure that the site is legally compliant. In practice, this will normally include a requirement for a business to have an effective Privacy & Cookie Policy and Cookie Notice on the landing page.

A Privacy & Cookie Policy is required when you are collecting personal data and/or using cookies. Typically a website will use cookies, but if you are in any doubt, this should be checked with your web developer or IT team.

Users of a website need to be made aware of what personal data is being collected and what cookies are being set when they interact with the website of that business.

Users also need to be told how their personal data and any cookies are stored and for how long, and how their information will be used. Having an effective Privacy & Cookie Policy in place will ensure your legal obligations are covered in this regard.

Remember also that if a business is collecting personal data, they may also need to be registered with the Information Commissioners Office as a data controller.
